Subscription, automatic renewal and cancellation
These are the terms you are agreeing to when you subscribe. Read this section even if you read nothing else.
Your subscription renews automatically
Paid plans renew by themselves at the end of each period, monthly or annual depending on what you chose, and your payment method is charged automatically at the then-current price, until you cancel.
Free trials become paid subscriptions
Paid plans begin with a 7 day free trial. Unless you cancel before the trial ends, it converts into a paid subscription and the first charge is taken on the day the trial ends. Our Free plan is not a trial, has no time limit, and never asks for a card.
Cancelling takes one step, in the same place you signed up
You signed up online, so you can cancel online, from your account settings, at any time. No phone call, no email required, no notice period, no cancellation fee. Cancelling stops the next charge and you keep access until the end of the period you already paid for.
What you pay
Pricing is a base plan fee plus a per-employee amount above the number of employees your plan includes. The exact figures shown on our pricing page at the time you subscribe are the figures that apply. If your staff count changes, the amount changes with it, and we bill only the difference.
Reminders and price changes
We send you a reminder before an annual plan renews, and a receipt after every charge. If we change your price, we will tell you at least 30 days before it takes effect, so you can cancel first if you would rather not pay it.
Who is charging you
EasyShift is the seller of record. Card payments are processed by Stripe, our payment processor. We charge your card, issue the invoice, apply any sales tax we are required to collect, and process refunds. Your bank statement will show EasyShift. Stripe never gives us your full card number; it is held by Stripe under their PCI-certified systems.
Refunds are covered in our refund policy, which forms part of this agreement.
Who may use EasyShift
EasyShift is for businesses. By accepting these terms you confirm you are at least 18, and that you have authority to bind the business you are signing up for. Accounts are for one business; sharing one account across unrelated businesses is not permitted.
What EasyShift is not
This matters more in your industry than in most, so we would rather say it plainly than hide it in a disclaimer.
EasyShift is a scheduling and record-keeping tool. It is not a payroll provider, a legal adviser, or a compliance product. It does not calculate wages owed, withhold taxes, determine overtime eligibility, enforce break rules, or tell you whether your practices satisfy the Fair Labor Standards Act or the labour laws of your state.
You remain the employer. You are responsible for paying your staff correctly, for keeping the records the law requires you to keep, and for how you use the hours and shift information the service records. Figures produced by EasyShift are an input to those decisions, not a substitute for them.
Location checks, if you switch them on
EasyShift can optionally verify that a clock-in happened at the venue. This is off unless you turn it on, it reads a single position at the moment of the clock-in, and it never runs in the background.
If you enable it, you are responsible for telling your staff before you begin. Several states require that notice in writing, and some require consent. We provide the mechanism; the employment relationship, and the notice obligation, remain yours.
A person who declines the device permission can still clock in. Their record simply shows that the location check was not available, and it is for you to decide what that means.
Your data, and your staff's data
The information you put into EasyShift stays yours. We do not sell it and we do not use it for our own purposes. We handle it as described in our privacy notice.
When you enter information about your staff, you are the one who decides what is collected and why, and we act on your instructions. You confirm that you are entitled to enter that information and to have us process it, and that you have given your staff whatever notice your state requires.
You can export your data at any time while the account is open. After an account closes we keep it for 90 days so it can be recovered, then delete it.
Acceptable use
Do not use EasyShift to break the law, to store data you have no right to hold, to attack or overload the service, to reverse engineer it, to resell access without our agreement, or to upload anything malicious. We may suspend an account that does, and we will tell you why.
Availability
We aim to keep the service running continuously, and we will give advance notice of planned maintenance where we can. We do not promise uninterrupted availability. Business and Chain plans include the response commitments described on the pricing page.
Ownership
EasyShift, its software, design and brand remain ours. You get the right to use the service while you are subscribed, and nothing more. Feedback you send us we may act on freely, without owing you anything for it.
Warranty disclaimer and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYSHIFT IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE OR LOST DATA. OUR TOTAL LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some states do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability for fraud or for anything that cannot lawfully be limited.
Ending the agreement
You may cancel at any time. We may suspend or end an account for non-payment, for a breach of these terms, or if we stop offering the service, in which case we will give you reasonable notice and refund any period you paid for but cannot use.
Changes to these terms
We may update these terms. For changes that materially affect your rights or what you pay, we will notify account holders at least 30 days in advance, and continuing to use the service after that date means you accept them. If you do not, cancel before the date and you will not be charged again.
Governing law and disputes
This agreement is governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules, and the parties submit to the courts located there. If you are a US resident, nothing in this section removes your right to bring a matter before your state's consumer protection authority or a small claims court.
